Welcome to PakEscrow.

These Terms & Conditions ("Terms", "Terms and Conditions", or "Agreement") govern your access to and use of the PakEscrow website, platform, escrow services, and related services (collectively, the "Services").

PakEscrow ("PakEscrow", "we", "us", or "our") provides an online platform intended to facilitate transactions between buyers and sellers by allowing funds to be held in escrow according to the applicable transaction terms.

By creating an account, accessing our website, initiating a transaction, accepting an escrow transaction, or otherwise using the Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use PakEscrow.

1. Eligibility

You must meet the minimum legal age and other requirements applicable to using our Services.

By using PakEscrow, you represent and warrant that:

You have the legal capacity to enter into these Terms;

The information you provide is accurate and complete;

You will keep your account information accurate and up to date;

You will use the Services only for lawful purposes; and

You will comply with all applicable laws and regulations.

If you are using PakEscrow on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. About PakEscrow

PakEscrow provides technology and transaction-management services intended to facilitate escrow arrangements between users.

Unless expressly stated otherwise, PakEscrow is not:

The buyer of goods offered by sellers;

The seller of goods or services offered by users;

A party to the underlying commercial agreement between a buyer and seller;

A guarantor of the quality, legality, delivery, or performance of goods or services;

An insurer of transactions; or

Responsible for the underlying product or service provided by a user.

The buyer and seller remain responsible for agreeing on the terms of their underlying transaction.

3. Creating an Account

Certain Services may require you to create an account.

You agree to provide accurate and complete information when registering.

You are responsible for:

Maintaining the confidentiality of your login credentials;

Preventing unauthorized access to your account;

All activity conducted through your account, subject to applicable law; and

Immediately notifying us if you suspect unauthorized access.

You must not:

Create an account using false information;

Impersonate another person or business;

Create accounts for fraudulent purposes;

Share your account with unauthorized persons; or

Use another person's account without permission.

PakEscrow may require additional verification before allowing certain transactions or account activities.

4. Identity and Account Verification

To protect users and the platform from fraud and abuse, PakEscrow may require users to verify their identity, contact information, business information, or other information.

Verification may include requests for appropriate documentation or information.

We may refuse, delay, limit, suspend, or cancel transactions where verification cannot be completed satisfactorily or where we reasonably suspect fraud, unauthorized activity, or other security concerns.

5. Escrow Transactions

A typical escrow transaction may involve:

A buyer and seller agreeing to transaction terms;

The buyer initiating an escrow transaction;

The buyer depositing the agreed amount using an available payment method;

PakEscrow recording or confirming the escrow payment;

The seller providing the agreed product or service;

The buyer confirming completion or the applicable transaction period expiring;

A dispute being raised, if applicable; and

Funds being released, refunded, or otherwise handled according to the transaction terms.

The exact process may vary depending on the transaction type and payment method.

6. Transaction Agreement Between Buyer and Seller

Before initiating a transaction, the buyer and seller should clearly agree on:

Product or service;

Price;

Quantity;

Delivery method;

Delivery or completion date;

Acceptance criteria;

Warranty or return arrangements, if any;

Applicable deadlines; and

Any other important conditions.

PakEscrow is not responsible for unclear, incomplete, misleading, or inaccurate agreements between users.

Users should ensure that all important transaction terms are recorded through the PakEscrow platform where possible.

7. Funding an Escrow Transaction

A buyer must provide the required funds using a payment method supported by PakEscrow.

An escrow transaction may not become active until payment has been successfully received or confirmed.

Payment processing may be subject to the terms and conditions of the applicable bank, payment gateway, mobile wallet, financial institution, or other payment provider.

PakEscrow may place a transaction on hold where:

Payment status cannot be verified;

A payment appears suspicious;

A payment is reversed or disputed;

Additional verification is required; or

We are required to do so for security or legal reasons.

8. Release of Escrow Funds

Funds may be released to the seller when the conditions applicable to the transaction have been satisfied.

Release may occur following:

Buyer confirmation;

Expiration of an applicable inspection or dispute period;

Mutual agreement between buyer and seller;

Resolution of a dispute;

Other release conditions agreed for the transaction.

Once funds have been released, recovering those funds may not be possible.

Users should therefore carefully review a transaction before approving the release of funds.

9. Refunds and Cancellations

Refunds and cancellations are governed by our Refund & Cancellation Policy and the applicable transaction terms.

A refund may be considered where:

A transaction is cancelled before completion;

The seller fails to meet agreed requirements;

A dispute is resolved in favor of the buyer;

A payment error occurs; or

Another circumstance justifies a refund.

A refund is not automatically guaranteed merely because a user requests one.

Please review our Refund & Cancellation Policy for additional information.

10. Disputes

If a buyer and seller disagree regarding a transaction, either party may initiate a dispute through the procedures provided by PakEscrow.

During a dispute, PakEscrow may temporarily prevent the release of funds.

We may request evidence including:

Transaction agreements;

Messages;

Delivery records;

Invoices;

Photos or videos;

Documents;

Screenshots;

Product or service specifications; and

Other relevant information.

Each party is responsible for providing truthful and relevant evidence.

After reviewing the available information, PakEscrow may determine an appropriate resolution under the applicable transaction terms.

A resolution may include:

Releasing funds to the seller;

Refunding funds to the buyer;

Dividing the funds between the parties;

Cancelling the transaction; or

Continuing to hold funds while additional information is obtained.

11. PakEscrow's Role in Disputes

PakEscrow may facilitate dispute resolution, but we do not guarantee that either party will receive the outcome they request.

Our review may be based on the information and evidence reasonably available to us.

We may decline to determine a dispute where:

There is insufficient evidence;

The transaction is outside our Services;

The matter requires a court or regulatory determination;

The transaction violates these Terms;

Fraud or unlawful activity is suspected; or

Another reasonable basis exists.

Where appropriate, the parties may be required to resolve the underlying dispute through another legally available process.

12. Seller Responsibilities

Sellers are solely responsible for:

Accurately describing their products or services;

Providing products or services as agreed;

Meeting agreed delivery deadlines;

Providing lawful goods and services;

Providing evidence of completion or delivery where required; and

Complying with applicable laws.

Sellers must not use PakEscrow to sell prohibited, fraudulent, counterfeit, stolen, illegal, or unauthorized goods or services.

13. Buyer Responsibilities

Buyers are responsible for:

Providing accurate transaction information;

Making payments using authorized payment methods;

Reviewing transaction terms before funding;

Inspecting delivered goods or services within the applicable period;

You may not use the Services to:

Commit fraud or financial crimes;

Launder money;

Finance unlawful activities;

Sell stolen or counterfeit goods;

Sell unauthorized financial products;

Conduct deceptive or fraudulent schemes;

Circumvent applicable laws or regulations;

Use someone else's identity or payment information;

Attempt unauthorized access to another account;

Distribute malware or malicious software;

Manipulate transactions or reviews;

Abuse refunds or disputes;

Create fake transactions;

Engage in harassment, threats, or abuse; or

Conduct any activity that could reasonably expose PakEscrow or its users to legal, financial, or security risks.

PakEscrow may maintain or publish additional prohibited-transaction rules from time to time.

15. Fees

PakEscrow may charge fees for certain Services.

Applicable fees will be displayed or otherwise communicated before the relevant transaction is completed where reasonably practicable.

Fees may include:

Escrow service fees;

Payment-processing fees;

Withdrawal or payout fees;

Currency-conversion fees;

Other applicable service fees.

Third-party payment providers may charge additional fees independently of PakEscrow.

Unless otherwise stated in our Refund Policy or required by applicable law, fees may be non-refundable once a service has been provided or a transaction has been processed.

16. Third-Party Payment Providers

Payments may be processed through third-party payment gateways, banks, mobile-wallet providers, financial institutions, or other payment services.

Your use of such payment services may be subject to their own terms and privacy policies.

PakEscrow is not responsible for failures, delays, restrictions, or outages caused by third-party payment providers, except to the extent required by applicable law.

PakEscrow may impose transaction, withdrawal, account, or other limits.

Limits may be based on factors including:

Account verification;

Transaction history;

Security requirements;

Payment-provider restrictions;

Risk controls;

Applicable law; or

Other legitimate business requirements.

We may change limits from time to time.

18. Fraud Prevention and Security Holds

To protect users and the platform, PakEscrow may monitor transactions for suspicious or unusual activity.

We may place a transaction or account on hold where we reasonably believe there may be:

Fraud;

Unauthorized activity;

Payment reversal;

Identity issues;

Security risks;

Violation of these Terms; or

Legal or regulatory concerns.

A security hold may remain in place for as long as reasonably necessary to investigate or resolve the relevant issue.

19. Account Suspension and Termination

We may suspend, restrict, or terminate an account where we reasonably believe that:

The user violated these Terms;

The user provided false information;

Fraudulent activity occurred;

The account presents a security risk;

The user engaged in prohibited activity;

The account is involved in suspicious transactions;

A legal or regulatory requirement requires action; or

Continued access could harm PakEscrow or other users.

Where appropriate, we may provide notice before taking action. However, immediate action may be taken where necessary to protect users, funds, security, or legal interests.

20. Effect of Account Termination

Termination of an account does not automatically cancel existing financial or contractual obligations.

Where funds remain associated with an active transaction, PakEscrow may continue processing that transaction or hold the funds as reasonably necessary to determine the appropriate outcome.

Certain information may also be retained after account termination as required or permitted by applicable law, security requirements, dispute resolution, accounting requirements, or our Privacy Policy.
